1. Who we are
FULKLORE is operated by Alexandru Bran ("we", "us", the "Seller"). By using FULKLORE (the "Service"), you enter into an agreement with the Seller on these terms.
2. Acceptance
By creating an account, accessing, or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are of legal age to enter this agreement in your jurisdiction, or that a parent or guardian consents on your behalf.
3. The Service
FULKLORE is a platform for independent artists to publish music and for listeners to discover, stream, and purchase that music. Features and content may change over time.
4. Accounts
You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity under your account. Notify us immediately of any unauthorized use.
5. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for any unlawful, fraudulent, or deceptive purpose;
- upload content you do not have the rights to, or that infringes any third party's intellectual property or privacy;
- send spam, malware, or attempt to probe, scan, or breach the security of the Service;
- scrape, copy, or redistribute Service content except as expressly permitted;
- attempt to reverse engineer, resell, or circumvent technical limits of the Service.
6. Intellectual property
The Service, its software, branding, and design are owned by the Seller and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected. Music uploaded by artists remains the property of those artists; by uploading, artists grant us a license to host, stream, and distribute that content solely to operate the Service.
7. Payments, subscriptions, and billing
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, taxes, cancellations, and refunds are subject to the Paddle Checkout Buyer Terms in addition to these Terms.
Subscriptions renew automatically at the cadence displayed at checkout until you cancel. When you cancel, you keep access until the end of the paid period. See our Refund Policy.
8. Service level
We work to keep the Service available and reliable, but we do not guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, pose a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time.
10. Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence where such exclusion is prohibited by law.
11. Changes
We may update these Terms from time to time. Continued use after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction of the Seller's residence, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction, unless applicable law provides otherwise.
